ਮੁੱਲਾਂਪੁਰ ਨੇੜੇ ਕਰੀਬ 2800 ਏਕੜ ਜ਼ਮੀਨ ਖਾਲੀ ਕਰਨ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਵੱਡਾ ਝਟਕਾ ਲੱਗਾ ਹੈ। ਹਾਈਕੋਰਟ ਨੇ ਇਸ ‘ਤੇ ਰੋਕ ਲਗਾ ਦਿੱਤੀ ਹੈ। ਇੱਥੇ ਫੌਜਾ ਸਿੰਘ ਕੰਪਨੀ ਕੋਲ ਕਰੀਬ 1200 ਏਕੜ ਜ਼ਮੀਨ ਛੁਡਾਉਣ ਦਾ ਦਾਅਵਾ ਸੀ। ਜਿਸ ਦੇ ਖਿਲਾਫ ਉਹ ਹਾਈ ਕੋਰਟ ਗਏ ਸਨ। ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਪੰਜਾਬ ਸਰਕਾਰ ਦਾ ਵਕੀਲ ਕੋਈ ਤਸੱਲੀਬਖਸ਼ ਜਵਾਬ ਨਹੀਂ ਦੇ ਸਕਿਆ। ਜਿਸ ਤੋਂ ਬਾਅਦ ਹਾਈਕੋਰਟ ਨੇ ਨੋਟਿਸ ਜਾਰੀ ਕਰਕੇ ਪੂਰਾ ਜਵਾਬ ਮੰਗਿਆ ਹੈ। ਮਾਮਲੇ ਦੀ ਅਗਲੀ ਸੁਣਵਾਈ 22 ਅਗਸਤ ਨੂੰ ਹੋਵੇਗੀ।
ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਫੌਜਾ ਸਿੰਘ ਕੰਪਨੀ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਉਨ੍ਹਾਂ ਨੇ ਇਹ ਜ਼ਮੀਨ ਪੰਚਾਇਤ ਤੋਂ ਨਹੀਂ ਖਰੀਦੀ। ਇਹ ਉਸ ਤੋਂ ਪਹਿਲਾਂ ਕਿਸੇ ਹੋਰ ਦੀ ਮਲਕੀਅਤ ਸੀ। ਜਿਸ ਤੋਂ ਉਸ ਨੇ ਇਹ ਜ਼ਮੀਨ ਲੈ ਲਈ। ਇਹ ਪੰਚਾਇਤੀ ਜ਼ਮੀਨ ਹੈ, ਸਰਕਾਰ ਨੂੰ ਇਸ ਬਾਰੇ ਪਹਿਲਾਂ ਮਾਲਕ ਤੋਂ ਜਾਂਚ ਕਰਨੀ ਚਾਹੀਦੀ ਹੈ। ਇਸ ਦੇ ਨਾਲ ਹੀ ਜ਼ਮੀਨ ਨੂੰ ਲੈ ਕੇ 8 ਜੂਨ ਨੂੰ ਆਰਡਰ ਆਇਆ ਸੀ। ਇਸ ਦੀ ਕਾਪੀ ਕੰਪਨੀ ਨੂੰ ਨਹੀਂ ਦਿੱਤੀ ਗਈ। ਜਦੋਂ ਤੱਕ ਉਨ੍ਹਾਂ ਨੂੰ ਪਤਾ ਲੱਗਾ, ਉਦੋਂ ਤੱਕ ਸਰਕਾਰ ਨੇ ਕਬਜ਼ਾ ਕਰ ਲਿਆ ਸੀ।
ਇਸ ਦੀ ਸੁਣਵਾਈ ਹਾਈ ਕੋਰਟ ਦੇ ਜਸਟਿਸ ਏ.ਜੀ. ਮਸੀਹ ਅਤੇ ਜਸਟਿਸ ਸੰਦੀਪ ਮੌਦਗਿਲ ਦੀ ਡਬਲ ਬੈਂਚ ਨੇ ਕੀਤੀ। ਉਨ੍ਹਾਂ ਦੇ ਸਾਹਮਣੇ ਕੰਪਨੀ ਨੇ ਜ਼ਮੀਨ ਦੇ ਪੁਰਾਣੇ ਦਸਤਾਵੇਜ਼ ਵੀ ਰੱਖੇ ਹੋਏ ਸਨ। ਜਿਸ ਬਾਰੇ ਸਰਕਾਰੀ ਵਕੀਲ ਕੋਈ ਠੋਸ ਸਬੂਤ ਜਾਂ ਦਲੀਲ ਪੇਸ਼ ਨਹੀਂ ਕਰ ਸਕਿਆ। ਹਾਈਕੋਰਟ ਨੇ ਇਸ ਗੱਲ ਦਾ ਵੀ ਨੋਟਿਸ ਲਿਆ ਕਿ ਸਰਕਾਰ ਨੇ ਅਚਾਨਕ ਕਬਜ਼ਾ ਲੈਣ ਦੀ ਕਾਰਵਾਈ ਕਿਉਂ ਕੀਤੀ।
